Fishypic ("Fishypic") takes intellectual property rights seriously. As stated in the Terms And Conditions, Users are prohibited from uploading content in violation of the law or that infringes upon another person’s copyrights or trademarks. Fishypic, at its discretion, may temporarily or permanently disable the account of any User who violates or infringes upon the copyrights of another.

Fishypic will respond to all allegations of copyright or trademark infringement. If you are a copyright or trademark owner, you may report any alleged violation by providing in writing the information set forth below and submitting it to Fishypic’s Intellectual Property Agent. Upon receipt of a notice of potential infringement, Fishypic will take any action it deems appropriate, in its sole discretion, including the removal of such infringing content and/or the termination of User accounts.

Copyright Infringement Notice

When submitting a notice of copyright infringement, please include the following:

1. A full description of the copyrighted work which you claim has been infringed, including identification of the material which you claim is causing the infringement.
2. A description, to the best of your ability, of the location(s) of the infringing material, such as links or the URL of the webpages where the infringing material can be located.
3. Your full name and contact information for the purpose of responding or to answer any additional questions regarding the nature of the infringement.
4. The following two statements followed by your signature: "I hereby state that I have a good faith belief that the disputed use of the copyrighted material or reference or link to such material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)." "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."

User Rights following a Copyright Complaint

If you believe original content was removed in error by Fishypic pursuant to an allegation of copyright infringement, you may file a counter-notice with Fishypic. Upon receipt of a counter-notice, Fishypic will notify the person filing the original notice of infringement and request that person to seek a court order preventing the infringement. In the event a court order is not sought, Fishypic may, but is not obligated to, restore the material to the Site.

Note: There are legal and financial consequences for fraudulent and/or bad faith submissions. Before submitting a counter-notice, be sure that you are the actual rights holder of the removed content or that you have a good faith belief that the material was removed in error, and understand the repercussions of submitting a false claim.

Copyright Infringement Counter Notice

When submitting a copyright infringement Counter Notice, please include the following:

1. A full description of the basis upon which you claim the original notice of infringement was in error, including the reasons you content such content or information is not a copyright infringement.
2. A description, to the best of your ability, of the location(s) in which the alleged infringing material was removed, such as links or the URL of the webpages where the infringing material can be located.
3. Your full name and contact information for the purpose of responding or to answer any additional questions regarding the nature of the infringement.
4. A statement that you consent to the jurisdiction of the Federal District Courts and that you will accept service of process from the person who provided the original notice of infringement.
5. A statement that, under penalty of perjury, you have a good faith basis for believing that the content was removed in error.

Trademark Infringement

If you have reason to believe a User is using your trademark on the Site in an infringing way and without your authority, please notify our Support Department AND notify us in writing. Upon receipt of a notice of potential infringement, Fishypic will take any action it deems appropriate, in its sole discretion, including the removal of such infringing content and/or the termination of User accounts.
